1. Our Philosophy
The Exquisite Co. creates handcrafted chocolate of a considered, artisanal nature. Each piece is produced in small batches with an emphasis on precision, balance, and elevated presentation.
By purchasing from us, you enter into a transaction governed by care, craftsmanship, and the following Terms.
2. Nature of Our Products
Our products are:
• Hand-finished
• Produced in small batches
• Temperature-sensitive
• Subject to natural variation
Subtle differences in colour, gloss, texture, or finish are inherent to artisally crafted chocolate and do not constitute defects.
Weights are approximate.
We reserve the right to refine recipes, moulds, finishes, and packaging at our discretion.
3. Pricing & Payment
All prices are in AUD and inclusive of GST where applicable.
We reserve the right to:
• Adjust pricing without notice
• Cancel orders affected by technical or pricing errors
• Refuse orders deemed fraudulent or high-risk
Full payment is required prior to dispatch unless otherwise agreed in writing.
4. Temperature & Transit Risk
Chocolate is sensitive to climate.
Risk transfers to the customer upon dispatch.
We are not liable for:
• Softening
• Cosmetic bloom
• Minor texture shifts
• Heat-related changes
Such changes do not constitute fault under Australian Consumer Law.
Customers accept transit temperature risk at time of purchase.
5. Returns & Consumer Guarantees
Due to the perishable nature of our goods, we do not accept returns for change of mind.
Remedies will be offered only where required under Australian Consumer Law, including where goods are:
• Not of acceptable quality
• Wrong Product
• Unsafe
Claims must be submitted within 48 hours of delivery with photographic evidence.
Our liability is strictly limited to replacement or refund of the product value.
We are not liable for indirect, commercial, or reputational losses.
6. Intellectual Property
All trademarks, mould designs, product names, copy, photography, and packaging are the exclusive property of The Exquisite Co.
Reproduction, imitation, or derivative adaptation is strictly prohibited without written consent.
7. Use of Brand Content
By tagging @theexquisiteco, submitting imagery, or interacting publicly with our brand, you grant us a non-exclusive, royalty-free licence to repost for marketing purposes.
8. Limitation of Liability
To the fullest extent permitted by law:
• Liability is capped at the purchase price of goods supplied
• We are not liable for business interruption, lost profits, or indirect damages
• No oral representations override these terms
9. Governing Law
These Terms are governed by the laws of Western Australia.
